GSiK-Teilprojekt Juristische Fakultät

Der inhaltliche Beitrag der Juristischen Fakultät zum GSiK-Projekt ruht auf zwei Grundpfeilern. Der erste enthält die Grundbegriffe, Theorien und Denkmodelle, die sich hinter dem Begriff der interkulturellen Kompetenz verstecken. Der zweite befasst sich mit dem Verhältnis von Recht und Interkulturalität. Dies lässt sich aus drei Blickwinkeln konkretisieren: Erstens, indem man versucht, Recht als kulturelles Phänomen zu begreifen. Zweitens, indem man Rechtskonflikte mit interkulturellem Hintergrund analysiert. Und drittens, indem man vergleichend konkrete Inhalte ausländischen und internationalen Rechts betrachtet.

The Legal System in India - Prof. G.S. Bajpai, NLU Delhi

Workshop: 09./10. Januar 2015

This course envisages to introduce the history, growth and emerging trends in the legal system of India. The structure of the course would primarily include lining the history, outlining the impact of the British regime and shaping of the contemporary legal institutions in India. Next, the course contents will let the students familiarize with the contours accusatorial basis of the legal system in India, which is different from the continental legal system generally followed in the European nations. At the third level, nature, structure and functions of legal institutions would be dealt with, which will emphasize the constitutional governance, jurisdictions and  hierarchy of courts, prosecution, prison and juvenile justice system in India.

Criminal Law in India - Prof. G.S. Bajpai, NLU Delhi

Workshop: 16./17. Januar 2015

The course will familiarize the participants with the structure of criminal laws in India. Criminal laws in India are broadly categorized in two parts- substantial and procedural. The substantial law is the Indian Penal Code and procedural laws are the Criminal Procedure Code and Indian Evidence Act. Another category of laws is the local and special laws. This course will aim at highlighting the key characteristics and the extent to which they met the changing demands of the society. The procedural law in India is the key instrument in ensuring the fair trial and rights of accused and other parties.
